As they have not entered a contract of employment there will be certain rights they will not be entitled to. Interns generally won’t be entitled to national minimum wage (NMW), holiday pay or protection from dismissal. However, interns are protected from harassment and discrimination.
When you pay an intern there is a potential that an employment contract has accidentally be entered (yes, without having to read or sign anything!). This means the intern would be classed as a worker and would be entitled automatically to the national minimum wage and holiday pay. From there, the question could be raise whether the intern is actually an employee entitled to full employment rights.
